MTJ Wellness Center, including its owners, operators, affiliates, contracted professionals, employees, agents, and service providers, collectively referred to as “MTJ Wellness,” “Company,” “we,” “our,” or “us,” welcomes you to our website located at MTJWellnessCenter.com and any related pages, forms, scheduling tools, communications, or online services made available by us, collectively referred to as the “Site” or “Services.”

These Terms and Conditions govern your access to and use of the Site and Services. By accessing the Site, submitting information through the Site, booking an appointment, communicating with us, purchasing a service, or otherwise using our Services, you agree to be bound by these Terms and Conditions. If you do not agree, you should not use the Site or Services.

2. Nature of Services

MTJ Wellness provides wellness, aesthetic, and medical-support services that may include, without limitation, advanced lab testing, hormone evaluation, peptide therapy, IV drip therapy, body composition support, Botox and dermal filler services, wellness consultations, and other related offerings.

Certain services may be provided by or under the supervision of licensed medical professionals, where required by law. MTJ Wellness may provide administrative, scheduling, technology, marketing, patient-support, and non-clinical services. Licensed medical professionals are solely responsible for clinical decision-making, diagnosis, treatment recommendations, prescriptions, and patient care within the scope of their professional licensure.

Availability of services may vary based on location, provider availability, medical eligibility, applicable law, and professional judgment.

3. No Emergency Services

The Site and Services are not intended for medical emergencies or urgent medical situations.

If you are experiencing a medical emergency, severe allergic reaction, chest pain, difficulty breathing, loss of consciousness, signs of stroke, severe infection, severe pain, suicidal thoughts, or any other urgent condition, call 911 or go to the nearest emergency room immediately.

Do not use this Site, online forms, text messages, email, scheduling tools, or any MTJ Wellness communication channel for emergency care.

4. Website Content Is Not Medical Advice

The information provided on the Site, in marketing materials, in social media content, by automated tools, or through general communications is for informational and educational purposes only. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Use of the Site does not create a physician-patient, provider-patient, or clinician-patient relationship. A clinical relationship is established only after appropriate intake, review, consent, acceptance by a licensed provider where applicable, and any other steps required by law or professional standards.

You should not disregard, delay, or avoid professional medical advice because of information obtained from MTJ Wellness’s Site or marketing materials.

5. Medical Eligibility and Provider Discretion

Not all individuals are eligible for all services. Eligibility for any medical, aesthetic, hormone-related, peptide-related, injectable, IV, or lab-based service may require intake forms, medical history review, laboratory testing, physical evaluation, informed consent, provider consultation, or other screening.

MTJ Wellness and/or the applicable licensed provider may refuse, delay, modify, or discontinue any service if, in the provider’s professional judgment, the service is not appropriate, safe, lawful, or medically indicated.

No service, product, treatment, or program is guaranteed to produce a specific result.

6. Your Responsibilities

By using the Site or Services, you agree to provide accurate, complete, and current information. This includes, without limitation, your name, contact information, medical history, medication history, allergies, health conditions, prior procedures, pregnancy status, lab history, and any other information requested by MTJ Wellness or a licensed provider.

You agree not to omit material health information or provide false information. Failure to provide accurate information may increase health risks and may result in denial, cancellation, or discontinuation of services.

You are responsible for following all instructions provided by MTJ Wellness and/or your licensed provider, including pre-treatment instructions, aftercare instructions, medication instructions, lab instructions, follow-up recommendations, and safety warnings.

7. Informed Consent and Treatment Risks

Certain services may involve risks, side effects, contraindications, complications, discomfort, bruising, swelling, infection, allergic reaction, lack of desired results, or other adverse outcomes. These risks may vary depending on the service, your health status, medications, allergies, anatomy, and other individual factors.

Before receiving certain services, you may be required to review and sign one or more informed consent forms. Those consent forms are separate from these Terms and Conditions and may contain service-specific risks, benefits, alternatives, and instructions.

You understand that aesthetic, wellness, hormone, peptide, injectable, IV, and other services may involve inherent risks and that results vary from person to person.

8. Lab Testing and Health Information

MTJ Wellness may coordinate or offer access to laboratory testing as part of certain programs or services. Lab testing may be performed by third-party laboratories or diagnostic service providers.

Lab results should be interpreted by a qualified healthcare professional. Abnormal, urgent, or concerning lab results may require follow-up with your primary care provider, a specialist, urgent care, or emergency services. MTJ Wellness does not replace your primary care physician or any specialist involved in your care.

You remain responsible for seeking appropriate follow-up care, especially for abnormal results or symptoms that require evaluation outside the scope of MTJ Wellness’s services.

9. Prescriptions, Products, and Treatment Plans

Where applicable, prescriptions, compounded medications, peptides, hormones, injectables, or other treatment products may be recommended or prescribed only by appropriately licensed providers acting within the scope of their professional judgment and applicable law.

You agree to use any prescribed or recommended product only as directed. You may not share, transfer, resell, misuse, alter, or administer any product to another person.

You are responsible for reporting side effects, adverse reactions, medication changes, new diagnoses, pregnancy, planned surgery, or other relevant health changes to MTJ Wellness and/or your provider.

10. No Guarantee of Results

MTJ Wellness does not guarantee any specific outcome from any service, treatment, product, program, consultation, lab test, aesthetic procedure, wellness plan, hormone program, peptide program, IV therapy, or other offering.

Results may vary based on age, health status, genetics, lifestyle, compliance, medical history, medications, baseline condition, and other factors.

Testimonials, before-and-after images, examples, reviews, or marketing materials reflect individual experiences and do not guarantee that you will experience the same or similar results.

11. Appointments, Cancellations, and No-Shows

Appointment availability is not guaranteed. MTJ Wellness may require deposits, consultation fees, cancellation fees, or no-show fees. Specific appointment, cancellation, refund, or rescheduling policies may be provided at the time of booking or purchase.

MTJ Wellness reserves the right to cancel, reschedule, or refuse appointments due to provider availability, safety concerns, incomplete intake forms, failure to provide required information, failure to complete required labs, late arrival, inappropriate conduct, or other operational or clinical reasons.

12. Payments, Fees, and Refunds

You agree to pay all fees associated with services, consultations, products, memberships, packages, lab testing, procedures, or other purchases made through or with MTJ Wellness.

Unless otherwise stated in writing, fees for completed consultations, rendered services, administered treatments, ordered labs, opened products, custom programs, and missed appointments may be non-refundable.

Pricing, service descriptions, promotions, and availability may change at any time. MTJ Wellness is not responsible for typographical errors, outdated pricing, or incorrect information displayed on third-party platforms.

13. Insurance

Unless expressly stated otherwise, MTJ Wellness services may be elective, wellness-based, aesthetic, cash-pay, or not covered by insurance. MTJ Wellness does not guarantee insurance reimbursement for any service, lab, consultation, prescription, or treatment.

You are responsible for confirming coverage, benefits, reimbursement eligibility, and out-of-pocket costs with your insurance provider.

14. Communications; Email; Phone; Text Messages

By providing your phone number, email address, or other contact information, you authorize MTJ Wellness and its service providers to contact you regarding appointments, intake forms, lab testing, treatment information, account matters, billing, promotions, follow-up care, and other service-related matters.

Communications may occur by phone, email, text message, automated message, or other electronic means. Message and data rates may apply.

You may opt out of marketing text messages by replying STOP where applicable. You may still receive non-marketing communications related to appointments, billing, care coordination, safety, or services you requested.

Electronic communications may not always be secure. Do not send emergency, highly sensitive, or urgent medical information by email, text message, website form, or social media.

15. Privacy and Health Information

Your use of the Site and Services is also governed by MTJ Wellness’s Privacy Policy and, where applicable, any Notice of Privacy Practices or patient privacy materials provided by MTJ Wellness or affiliated healthcare providers.

These Terms and Conditions do not replace any required privacy notice, patient consent, authorization, or other healthcare documentation.

16. Third-Party Services

MTJ Wellness may use third-party platforms, vendors, laboratories, payment processors, scheduling tools, messaging services, analytics providers, pharmacies, technology platforms, marketing tools, or other service providers.

MTJ Wellness is not responsible for the acts, omissions, terms, privacy practices, security practices, or content of third-party services. Your use of third-party platforms may be governed by separate terms and policies.

Links to third-party websites or services are provided for convenience only and do not imply endorsement.

17. Accounts, Forms, and Online Submissions

You may be asked to complete forms, questionnaires, consents, or account information through the Site or a third-party platform. You agree that all information you submit will be accurate, current, and complete.

You are responsible for maintaining the confidentiality of any login credentials associated with your account or patient portal. You agree to notify MTJ Wellness promptly if you suspect unauthorized access to your account or information.

18. Intellectual Property

All content on the Site, including text, graphics, images, logos, icons, designs, videos, service descriptions, copy, layout, branding, and other materials, is owned by or licensed to MTJ Wellness and is protected by intellectual property laws.

You may not copy, reproduce, distribute, modify, publish, display, sell, license, or exploit any Site content without prior written permission from MTJ Wellness.

19. Prohibited Uses

You agree not to use the Site or Services to:

  1. Violate any law, regulation, or third-party right;

20. Promotions and Special Offers

Promotions, discounts, packages, memberships, or special offers may be subject to additional terms, expiration dates, eligibility requirements, and limitations. MTJ Wellness may modify, suspend, or discontinue any promotion at any time.

Promotional materials are not intended to imply that any service is medically necessary, risk-free, guaranteed, or appropriate for every individual.

21. Disclaimer of Warranties

The Site and Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, MTJ Wellness disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and uninterrupted operation.

MTJ Wellness does not warrant that the Site will be secure, error-free, uninterrupted, current, complete, or free from viruses or harmful components.

Nothing in these Terms and Conditions is intended to disclaim obligations that cannot be disclaimed under applicable law.

22. Limitation of Liability

To the fullest extent permitted by law, MTJ Wellness and its owners, operators, affiliates, employees, contractors, agents, providers, vendors, and representatives shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost data, lost business, reputational harm, or service interruption, arising out of or related to your use of the Site or Services.

Nothing in these Terms and Conditions limits liability that cannot be limited under applicable law, including liability for professional negligence where such limitation is not permitted.

23. Indemnification

You agree to defend, indemnify, and hold harmless MTJ Wellness, its owners, operators, affiliates, employees, contractors, agents, providers, vendors, and representatives from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  1. Your use or misuse of the Site or Services;

  2. Your violation of these Terms and Conditions;

  3. Your violation of any law or third-party right;

  4. Your submission of false, inaccurate, or incomplete information;

  5. Your failure to follow instructions, warnings, or aftercare guidance; or

  6. Your misuse of any product, prescription, recommendation, or service.

24. Termination of Access

MTJ Wellness may suspend, restrict, or terminate your access to the Site or Services at any time, with or without notice, if we believe you have violated these Terms and Conditions, provided false information, engaged in inappropriate conduct, created safety concerns, failed to pay amounts owed, or misused the Site or Services.

25. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict-of-law principles.

To the extent any dispute is not subject to arbitration or another dispute-resolution process, you agree that the state and federal courts located in New Jersey shall have exclusive jurisdiction, unless applicable law requires otherwise.

26. Dispute Resolution

To the fullest extent permitted by law, you agree to first attempt to resolve any dispute informally by contacting MTJ Wellness at the contact information listed above.

If a dispute cannot be resolved informally, the parties may be required to resolve the dispute through binding arbitration, unless prohibited by applicable law or unless the dispute involves a matter that cannot legally be arbitrated.

Any dispute-resolution provision shall not limit your ability to report concerns to licensing boards, regulatory agencies, law enforcement, or other governmental authorities.

27. Changes to These Terms

MTJ Wellness may update these Terms and Conditions from time to time. When changes are made, the updated version will be posted on the Site with a revised “Last Updated” date.

Your continued use of the Site or Services after updated Terms and Conditions are posted constitutes your acceptance of the revised Terms.

28. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.

29. Entire Agreement

These Terms and Conditions, together with any applicable Privacy Policy, Notice of Privacy Practices, informed consent forms, payment terms, appointment policies, membership terms, and other written agreements provided by MTJ Wellness, constitute the entire agreement between you and MTJ Wellness regarding your use of the Site and Services.

30. Acknowledgment

By using the Site, submitting information, booking an appointment, purchasing a service, or communicating with MTJ Wellness, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
